The meeting was opened by Debra Kesecker, County Clerk at 3:35 p.m.
Administration
On a Stacy Dugan/Thomas Swaim motion, the County Commission approved the minutes from the May 7, 2009 meeting. This motion carried.
Morgan County Patriot Award
The County Commission approved the Morgan County Patriot Award Certificate that Jerry Chaskes created. The certificate is to recognize residents that do special things for one another.
Quarterly Meetings
The County Commission discussed the possibility of holding meetings with the Mayors of Municipalities. The County Commission would meet with the Mayor of Paw Paw and Town of Bath to discuss and exchange ideas including grant projects, etc.
Trip to Lewisburg for Osteopathic Medicine
The Commission have set tentative dates to meet with the Director of the Lewisburg Osteopathic School of Medicine in Lewisburg, WV. The tentative dates set are June 2 or June 4, 2009.
Direct Deposit for Employees
Sheriff Vince Shambaugh will sign the paperwork along with Commissioners Dugan and Hutchinson to finalize the direct deposit for county employees to go into effect on July 1, 2009.
Community Resource Guide
Commissioner Dugan presented the Community Resource Guide she had created and discussed it with the Commission. The Commission agreed to put the community resource guide on the County Commission website.
Fundraiser for Relay for Life
Commissioner Hutchinson explained she is forming a courthouse team to participate in the Relay for Life event on June 6, 2009. Commissioner Hutchinson discussed having a lunch for local businesses for a fundraiser. The date tentatively set for the lunch is May 29, 2009.
Sheriff Vince Shambaugh- Tax Office Computers

- Sheriff Law- Alarm Ordinance
Community Service
Sheriff Shambaugh approached the Commission to discuss the community service program. Mr. Shambaugh explained that a deputy is supervising community service work, but it is a problem when the deputy gets called on an emergency call. Commissioner Swaim explained that years ago the Commission provided funds for the sheriffs department to hire a deputy to supervise the community service program. Mr. Shambaugh stated that the department is short 2 deputies. Commissioner Hutchinson stated that no resolution can made today and the Commission needs to further discuss and consider options. The Commission agreed to further discuss the issue and explore options.
Tax Office Computers
Chief Tax Deputy Kim Michael approached the Commission to discuss the possibility of upgrading the tax office computers. Ms. Michael explained to the Commission that the computers are running out of memory space. Ms. Michael stated she would need the new computer system before January. The Commission placed the item on the October 1, 2009 meeting agenda to further discuss and if approved, the system will be ordered by November 1, 2009 to ensure arrival and installation before January 2010.
False Alarm Issues
Sheriff Shambaugh presented a list of false alarm reports to the Commission. Sheriff Shambaugh explained the sheriff’s department had over 300 false alarm calls last year. Sheriff Shambaugh presented an alarm ordinance that Tucker County, West Virginia has in effect. Sheriff Shambaugh explained the ordinance allows homeowners with alarm systems to register for a fee and if the alarm goes off, the Sheriff’s Department will contact the homeowner. After 2 false alarms, the homeowners get charged for false alarms. Sheriff Shambaugh requested that the Commission create a similar ordinance for Morgan County. The Commission agreed to further discuss the ordinance and start to prepare a false alarm ordinance for Morgan County.
Tom Geiermann- Noise Ordinance-Questions?
Mr. Geiermann approached the Commission to explain a complaint he had concerning a concert held at Triple B Arena on Sunday, May 10, 2009. Mr. Geiermann explained he lived down the road from the arena. The music was very loud so he called the state police and was told that they do not have any authority because of the noise ordinance. The ordinance states that loud activity between the hours of 11:00 p.m and 6:00 a.m. is a disruption. Mr. Geiermann then called the Triple B Arena and said that when he spoke to someone about the loud music, he was cursed at. Mr. Geiermann explained that he just had some questions concerning the noise ordinance and would like to know that loud concerts were not going to continue. Bob Ford approached the Commission and
apologized to Mr. Geiermann and explained that the arena was rented out for the weekend and the renters had the voice volume too high. Mr. Ford stated that music concerts will not be held on Sundays again, and he reassured Mr. Geiermann this will not happen again. Mr. Geiermann stated he was very pleased with Mr. Ford attending the meeting and he was glad to talk to him. The County Commission discussed the noise ordinance with Vince Shambaugh, Sheriff of Morgan County, and decided to further discuss the option of amending the current noise ordinance which will allow the Sheriffs Department to respond to complaints from citizens.
David Zaken, Jr.- Interview for Solid Waste Authority Board
Mr. Zaken approached the Commission and expressed his interest in serving on the Solid Waste Authority Board. Mr. Zaken explained he had experience in environmental compliance, OSHA, industrial safety, water and sewer plant operation and landfill operation. Commissioner Hutchinson stated she thinks he is certainly qualified to be on the Board. The Commission agreed. On a Stacy Dugan/Thomas Swaim motion, the Commission appoints David Zaken, Jr. to the Solid Waste Authority Board. This motion carried.
Maxie Maggio- Records Management Contract
Ms. Maggio approached the Commission and presented a records management contract.
Ms. Maggio explained the grant is to purchase manually operated movable track shelving for the Circuit Clerk’s records room. On a Thomas Swaim/Stacy Dugan motion, the County Commission authorized Brenda J. Hutchinson, President of the Morgan County Commission to act on its behalf to enter into a contractual agreement with the Division of Culture and History to receive and administer funds pursuant to the provisions of the Records Management and Preservation Board Grant Program. This motion carried.
Discussion for EDA position
Maxie Maggio approached the Commission for an interview for the Economic Development Authority position. Ms. Maggio explained to the Commission that she used to help Bette with EDA responsibilities and she feels confident she can perform the duties herself. Commissioner Dugan stated she thinks Maxie is very talented and will do a good job. On a Stacy Dugan/Thomas Swaim motion, the County Commission agreed to hire Maxie Maggio to fill the vacant EDA position left by Bette Kidwell’s resignation and receive the monetary supplement that is included effective immediately. This motion carried.
Interviews for Farmland Protection Board
Ginger Johnson approached the Commission for an interview for the Farmland Protection Board. Ms. Johnson explained to the Commission that she had experience in meetings, preparing agendas and taking meeting minutes. Ms. Johnson explained that she had spoken to Bette Kidwell concerning the farmland protection board responsibilities and feels certain that she can perform the additional tasks along with being the Commission Secretary. Ms. Johnson stated that she understands she will no longer be the asst. county planner.
Peggy Oakes approached the Commission for an interview for the Farmland Protection Board. Ms. Oakes requested to have her interview in executive session.
On a Stacy Dugan/Thomas Swaim motion, the Commission went into executive session at 6:40 p.m.
This motion carried.
On a Thomas Swaim/Stacy Dugan motion, the County Commission reconvened into regular session at 7:00 p.m. This motion carried.
The County Commission discussed and came to a decision for the position on the Farmland Protection Board and made a motion. On a Stacy Dugan/Thomas Swaim motion, the Commission agreed to hire Ginger Johnson for the vacant Farmland Protection Board position left by Bette Kidwell’s resignation and receive the monetary supplement included effective immediately. This motion carried.
Addressing Position
The Commission will continue to discuss the possibility of additional monetary supplement to be paid to the addressing employee.
Administration Assistant Position
The Commission agreed to hire a part-time administrative assistant to write letters, grants and perform administration and general office duties. The employee will work 20 hours or less on an as needed basis. The Commission staff will place a help wanted ad in the Morgan Messenger newspaper.
Adjournment
On a Stacy Dugan/Brenda Hutchinson motion, the Commission adjourned the meeting at 7:40 p.m.
